1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Streamer", "you") and Yap-a-Thon ("Service", "we", "us", "our", and its creator/operator). By visiting, accessing, embedding, or using any part of Yap-a-Thon, our dashboard, OBS overlays, or related APIs, you agree that you have read, understood, and agreed to be bound by all of these Terms.
If you do not agree with all of these Terms, you are expressly prohibited from using the Service and should discontinue use immediately.
2. "As-Is" Service & No Warranties
Yap-a-Thon is provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, uptime, stream compatibility, and non-infringement.
We make no guarantees that the Service will meet your specific broadcast requirements, that speech recognition will be 100% accurate, that third-party webhooks (Twitch, YouTube, Kick, Streamlabs, StreamElements) will be delivered without delay, or that the overlay will operate without interruption or error. Any stream disruption, miscounted word quota, or software malfunction is solely at your own risk.
3. Plans, Pricing & Stripe Billing
Yap-a-Thon offers both free and premium access tiers. All paid transactions are securely handled by Stripe:
- Standard Free Tier: Free to use with no account required. Includes browser speech recognition, standard Twitch event tracking, and customizable OBS overlays. All the essentials to run a Yap-a-Thon.
- 24-Hour Event Pass ($5.99 one-time): Grants 24 consecutive hours of Creator tier features starting immediately upon confirmed payment. Event passes do not automatically renew and are strictly non-refundable once purchased, regardless of stream length, technical difficulties, or platform downtime.
- Creator Monthly Plan ($9.99/month): Recurring monthly subscription that unlocks full Creator features, priority speech recognition, tip tracking, YouTube super chats, sound alerts, and cloud presets. Subscriptions automatically renew at the end of each monthly billing cycle until canceled. You may cancel anytime via the Stripe Customer Portal or your account settings. Cancellation halts future billing cycles; partial or retroactive refunds for active billing periods are not provided. You will continue to have access to the Creator features until your billing cycle expires.
- Disputes & Chargebacks: Fraudulent chargebacks or payment disputes will result in immediate termination of all account privileges and permanent blacklisting from the Service.
4. Affiliate & Referral Program
Affiliate program is not yet open.
Participants in the Yap-a-Thon Affiliate Program may earn commissions by referring new paying creators. Participation is subject to program rules:
- Commissions are credited only on verified, non-refunded transactions made through valid referral links.
- We reserve the absolute and unilateral right to modify commission rates, payout minimums, or program terms at any time.
- Self-referrals, misleading promotions, spamming, and fraudulent traffic are strictly prohibited and will result in forfeiture of unpaid balances and immediate account termination.
5. Streaming Platform Guidelines & User Conduct
You are solely and exclusively responsible for the content you broadcast while using Yap-a-Thon. You agree to comply with all Terms of Service, Community Guidelines, and copyright rules of Twitch Interactive, YouTube, Kick, Streamlabs, and StreamElements.
You agree not to use Yap-a-Thon to promote hate speech, harassment, illegal content, or any activities that violate broadcasting platform rules. Yap-a-Thon is an independent tool and is not affiliated with, endorsed by, or sponsored by Twitch, Amazon, Google, YouTube, or Kick.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Yap-a-Thon, its creator, developers, affiliates, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever (including, without limitation, damages for loss of stream revenue, lost donations, missed subathon goals, loss of followers, stream interruptions, data loss, or emotional distress), arising out of or in connection with your use of or inability to use the Service.
In any event, our total cumulative liability to you for any and all claims arising out of or related to these Terms or your use of the Service shall not exceed the total amount actually paid by you to Yap-a-Thon in the one (1) month immediately preceding the event giving rise to liability, or $10.00 USD, whichever is less.
7. Indemnification
You agree to defend, indemnify, and hold harmless Yap-a-Thon, its creator, operators, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your stream broadcasts and spoken content; (c) your violation of any third-party platform rules or rights; or (d) your breach of these Terms.
If any dispute or claim arises between you, your viewers, streaming platforms, or third-party payment providers, you acknowledge and agree that the legal responsibility rests entirely with you.
8. Modifications & Termination
We reserve the right to modify, suspend, or discontinue any feature, plan, or aspect of the Service at any time, with or without notice. We may update these Terms periodically, and your continued use of Yap-a-Thon following any modifications constitutes full and binding acceptance of the updated Terms.
We reserve the right to terminate or restrict access to any user or streamer at our sole discretion, without liability, for any violation of these Terms.
9. Governing Law & Severability
These Terms shall be governed by and interpreted in accordance with applicable laws without regard to conflict of law principles. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
